Terms of Service

Please read these terms carefully. They include a binding arbitration agreement and a class action waiver that affect how disputes between you and us are resolved. You may opt out of arbitration within 30 days — see “Dispute resolution” below.

These terms govern your use of CompBasis (housingcomps.com). By using the site, you agree to them. If you don’t agree, please don’t use the site.

In these terms, “CompBasis,” “we,” “us,” and “our” mean the CompBasis service together with the individual or entity that owns and operates it and that party’s owners, operators, employees, contractors, and affiliates. Every disclaimer, limitation, release, and indemnity in these terms runs to all of them.

What CompBasis is

CompBasis generates informational property analyses for Illinois residential real estate — comp-supported valuation ranges, post-sale tax projections, school and flood-risk context, condition assessment, and a plain-language read on the property — built from public records and aggregated market data.

Not professional advice

Every report we generate is probabilistic, not a guarantee. Data has gaps, markets move, and nothing replaces having your own eyes on the property. CompBasis is built to inform your own judgment, not replace it — the decision, the due diligence, and the risk are yours. We never recommend that you buy, sell, or pass on a property; we provide analysis and let you decide.

CompBasis is not a licensed real estate broker, real estate salesperson, or real estate appraiser, and does not provide brokerage, appraisal, or property management services. Nothing on this site is an appraisal or a competitive market analysis prepared by a licensee, is not prepared in conformity with the Uniform Standards of Professional Appraisal Practice, and may not be used in place of an appraisal for any lending, tax, legal, or regulatory purpose. Nothing on this site is a substitute for a licensed home inspection, or for legal, tax, financial, accounting, or investment advice. For decisions that turn on any of those, consult an appropriately licensed professional.

CompBasis is also not a consumer reporting agency, our reports are not consumer reports, and we do not provide tenant screening, background screening, or credit decisioning. Reports may not be used for any purpose regulated by the Fair Credit Reporting Act — see “Acceptable use” below.

Eligibility

You must be at least 18 years old and able to form a binding contract to use CompBasis.

Accounts

Creating an account requires signing in with Google. You’re responsible for activity under your account. Let us know if you believe your account has been accessed without your permission.

Third-party data

Reports draw on data from RentCast, Cook County/Chicago open data, the U.S. Census Bureau, FEMA, the Illinois Department of Revenue, the Illinois State Board of Education, HUD, and the Federal Reserve. Where a data source requires its own disclaimer to be shown alongside data it supplies, our reports include it. We don’t control the accuracy of third-party data and aren’t responsible for errors in it.

Intellectual property

“CompBasis” and our branding, site, and software are ours. Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the reports we generate for you to evaluate a property for your own personal or internal business purposes.

That license is subject to the terms of the third-party data providers whose data the reports incorporate, several of which restrict redistribution. It does not permit you to resell, sublicense, publish, or redistribute reports or the underlying data, or to use them to build a competing product.

Changes to the service

CompBasis is provided free of charge and we may change, suspend, limit, or discontinue any part of it at any time without notice. We don’t promise any particular level of availability, uptime, or data coverage.

Disclaimer of warranties

CompBasis is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, title, and non-infringement. We don’t warrant that the site will be uninterrupted, error-free, or that any report is free of inaccuracies. Some jurisdictions don’t allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, CompBasis is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the site or reliance on a report — including a decision to buy, sell, or pass on a property, or to pay a particular price — even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims relating to CompBasis will not exceed the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions don’t allow certain limitations of liability, so some of these limits may not apply to you.

Indemnification

You agree to indemnify, defend, and hold CompBasis harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use or misuse of the site, your violation of these terms, or your violation of any law or the rights of any third party. This includes any claim brought against us by a third-party data provider arising from your use of data you obtained through CompBasis.

Termination

We may suspend or terminate access to the site at any time, including for a violation of these terms. You can stop using the site and delete your account at any time. Sections that by their nature should survive termination — including the disclaimers, limitation of liability, indemnification, and dispute resolution provisions — will survive.

Dispute resolution: arbitration and class action waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.

Except as set out below, you and CompBasis agree that any dispute, claim, or controversy arising out of or relating to these terms or to your use of CompBasis will be resolved by binding individual arbitration, rather than in court. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will take place in Cook County, Illinois, or, at your election, by telephone, videoconference, or on written submissions only. The arbitrator’s award may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and CompBasis agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to protect its intellectual property rights.

Your right to opt out. You may opt out of this arbitration agreement and class action waiver by emailing joelblunt81@gmail.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these terms, stating your name and the email address associated with your account. Opting out will not affect any other part of these terms, and it will not affect your use of CompBasis in any way.

If the class action waiver above is found unenforceable as to a particular claim, then that claim will proceed in court rather than in arbitration, and the rest of this section will remain in effect.

Governing law and venue

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. For any dispute not subject to arbitration under the section above, you and CompBasis agree to the exclusive jurisdiction of, and venue in, the state and federal courts located in Cook County, Illinois, and each party waives any objection to that jurisdiction or venue.

General

Severability. If any provision of these terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will stay in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer these terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you and CompBasis regarding the site, and supersede any prior agreements on that subject.

Changes to these terms

We’ll update the date at the top of this page when we make changes. Continued use of CompBasis after a change means you accept the updated terms.
